Divorce & Legal Separation Response — Sonoma County

If you have been served with divorce or legal separation papers in California, time matters. You generally have 30 days from the date of service to file a formal Response with the court. Failing to respond can result in a default judgment, meaning the court may grant everything the Petitioner requested—without your input.

In California family court, not responding can permanently cost you legal rights for the entirety of the case, including property division, debt allocation, custody, visitation, and support.

Minimum Engagement Standard

Our minimum charge for any family-law service is $500. Divorce and legal separation cases require due diligence, statutory compliance, and court-ready filings. These matters are not fill-in-the-blank paperwork.

Why Filing a Response Is Critical

A Response is your legal voice. Best practice is to address every request, allegation, and factual claim made by the Petitioner. If an issue is not challenged, the court may treat it as undisputed.

Custody, Allegations, and Rebuttals

In custody cases, Responses often require direct rebuttals to allegations of abuse, neglect, substance issues, financial misconduct, or bad parenting. The court cannot rule on evidence that is never submitted.

The Most Important Filing: Your Declaration

In our professional opinion, every party should file a detailed declaration with their Response. Declarations supported by evidence and witness statements (including MC-030 forms) are often the most influential documents the court reviews.

Many parties lose in court not because they are legally wrong, but because they failed to properly present facts, organize evidence, or meet procedural requirements.
